IRS Challenges to the Real Estate Professional Status

The IRS has been stepping up their audits of anyone who takes a real estate loss on their tax returns. Some of their arguments against the taxpayers are valid and a lot of them are not.

Here are some of the recent challenges to the real estate professional status by the IRS and what you can do about it.

IRS Argument:? A real estate agent is not a real estate professional

One of the allowed real estate professional activities is ?brokering? a deal.?? In some cases, the IRS has taken the position that a real estate agent doesn?t qualify because he or she is a not a broker. There have been at least three Tax Court rulings against the IRS when they have taken that position.

Bottom Line:? Real estate agent hours do count as real estate professional hours.

IRS Argument:? Material participation is 750 hours, not 500 hours

In earlier articles in this series, we talked about the need for material participation in order to claim the real estate professional deduction.? The amount needed is 500 hours per property, unless you aggregate properties in which case it is 500 hours total.

However, the IRS Audit Technique Guide (ATG) for real estate professionals has a mistake. In one place it says that the material participation is 750 hours. In another place, it correctly states that it is 500 hours.

Bottom Line: This mistake can mislead auditors, but it is wrong.

IRS Argument:? A limited partner in a limited partnership automatically does not qualify as a real estate professional

I need help with the IRS

The IRS seems to be rewriting the rules...

The IRS issued Proposed Regulations for Code Section 469 in December 2011. These clearly explain the situations under which a limited partner CAN have material participation.

Unfortunately, the IRS didn?t update their ATGs that they give auditors. The auditors are still trained to immediately deny any limited partners the benefit of real estate professionals.

There are also some IRS positions that aren?t clearly valid or invalid. For example, if you use a property manager, the IRS will likely deny that you are actively participating.

They began a massive audit offensive in June 2012, targeting most property managers in Arizona. During the audit, they are compiling lists of their real estate investor clients. At this point, we?re not certain exactly what they will be doing, but a best guess is that they will select these investors for audit.

Rewriting the Rules?

The IRS is checking on anyone who has received a Form 1099-A showing a foreclosure or deed-in-lieu-of foreclosure? If the property is in a state which is considered non-recourse, then the lender cannot pursue additional claims against the borrower. At that point, normally the lender will calculate how much the debt forgiveness is and issue a Form 1099-C.

Now the IRS says that as soon as you have a Form 1099-A, you have debt forgiveness income if you?re in a state where loans are non-recourse.

Although this last one doesn?t have anything to do with the real estate professional status, it demonstrates how the IRS is rewriting the rules or at the very least, sending out inexperienced auditors with incomplete and sometimes inaccurate handbooks.

It?s never been more important to make sure you have an experienced tax strategist and tax preparer helping you. It?s not enough to hire someone with some tax experience. If you have real estate, you need someone with real estate tax experience.

An AngelPad-incubated startup called LocBox helps those businesses manage their efforts in a way that's focused on acquiring customers and driving revenue ? and it just raised $5.1 million in Series A funding. The round was led by InterWest Partners, with participation from Google Ventures, Accel Partners, and 500 Startups. Individual investors included Anand Rajaraman and Venky Harinarayan of Kosmix (now WalMartLabs) and Deep Nishar, senior vice president of products and user experience at LinkedIn. (LocBox CEO Saumil Mehta was formerly director of product at Kosmix, and his co-founder/CTO?Sailesh Ramakrishnan was director of engineering.) PSG Angle: D-I-Y Investing ? the Opportunity and the Pitfalls

One of the drawbacks of being an asset manager is that there seems to be an inherent assumption by those outside of the industry that we should be able to determine which stocks are going to go up (or outperform) over the next week, month and year.?

Whilst this assumption may be misguided, our inability to predict short-term stock price movements not only disappoints but is often ridiculed when people who follow stocks for a hobby seem to be getting all their calls right.? Newspapers love publishing the article where the monkey throwing darts or the grade three kid doubles their money in a year on a stock pick while the investment professional ?s choice bombs.? We dread the conversation around the braai when your friend reminds you, generally quite loudly, how much money he is making on the stock you sold out of your portfolio two years ago.

One of the key theories of behavioral finance, which is the study of the impact of emotion on investment decisions, is that people generally have a tendency to overestimate their ability and are confident that they can consistently time their entry into and exit from the market.? Value-based investment management houses like ourselves fully acknowledge our inability to sustainably time the market or predict the path of near-term share prices.? We think that focusing all of our attention on determining what we think a stock is really worth, and ignoring what the herd thinks is going to happen in the near future, is a proven recipe for good long-term returns.? This means that we often sell good companies because we think the share is overpriced, not because it is a bad company.? We may underperform in the short-run but we expect to outperform in the long-run and take significantly less risk along the way.

Investing on the basis of share price momentum is a strategy that some investment managers have employed very effectively and winning stocks can outperform for a lot longer than one would think.? This is partly because an increasing stock price not only has the effect of reinforcing the confidence of those that own the stock that their thesis is appropriate, but it also attracts new investors who are drawn to a rising share price.? This is the self-feeding cycle that can result in bubbles in financial assets:? a dangerous combination of over-confidence and rising prices attracting new investors.

We unreservedly believe in the ability of equities to grow one?s wealth over time; it is our view that few investments can compound your savings over the long-run like a well-selected stock.? As long as you avoid overpaying, investing in good businesses with strong management teams can be a surprisingly simple and rewarding endeavour.? ?Hence, there is no reason that anybody doing the appropriate amount of fundamental research cannot make a good success of running their own portfolio.?

While disciplined D-I-Y investors can do surprisingly well and stock-picking can be a very satisfying hobby, there are a number of common mistakes that we all make.? These include:

  • Under-estimating risk.? Newer stock market participants tend to be more focused on returns than risk. ?As a result, not enough attention is given to the likelihood of being wrong and the inherent riskiness of a stock.? One poor investment decision can wipe out the gains on a number of good calls.? The reality is that the investment portfolio (and the investor?s stomach) needs to be able to stand up to unpredictable and extreme events.? 2008 is very fresh in most of our minds.
  • Failure to pick a strategy and stick to it.? It doesn?t matter whether your DNA is buy-and-hold or trader, choose your strategy and apply it in a disciplined fashion.? If you are looking for long-term gains you need to do your homework, be prepared to be contrarian and have a lot of patience.? If you are more speculative in nature, a tight stop loss is highly recommended.
  • Misunderstanding valuation. ?If there is a good story around a stock or a sector the market generally knows about it.? After all, stock prices incorporate expectations for the future.? If a stock price incorporates very good news it will generate poor returns unless it can positively surprise.
  • Sometimes a good company and a good stock are different things. ?Good shareholder returns tend to require good profit growth, a reasonable valuation and healthy dividends. A great brand or a great historic track record does not necessarily translate to strong investment returns in the future.
  • Lack of diversification.? The future is unpredictable and aggressive exposure to a small number of companies often means that an external and unpredictable event can materially impact the portfolio.? In addition, the JSE is a very concentrated stock market with a limited number of macro drivers.? Over-exposure to single drivers such as the SA consumer or global commodity markets can introduce significant risk if economic conditions deteriorate in that space.
  • Under-estimating how much value a poor management team can destroy.? Stocks are usually cheap for a reason.? A management team that allocates capital poorly or cannot be trusted to act in the interests of shareholders can quickly destroy value on a permanent basis.
  • Bragging about your winners. Nothing humbles like the stock market.? Today?s rooster is tomorrow?s feather-duster.

We are not arguing against D-I-Y investing.? Whilst we always recommend?making use of the services of qualified and experienced financial advisors and investment professionals to protect and grow your savings,??we laud anyone who makes the effort to involve themselves in their investments.??What we do advise, however, is an awareness of some of the pitfalls which often ensnare the novice.? Not focussing enough on these can lead to some very expensive lessons.

Pluck of the Irish | Daily Nutmeg

B efore she was organizing her days around ukulele lessons and booking gigs with her band, Liz McNicholl was a temp at Memorial Sloane-Kettering Cancer Center in New York City, having recently moved to the United States from County Meath, Ireland.

It?s a surprising detail if you know McNicholl, a familiar face?and voice?to children and adults alike in the New Haven arts scene. Music seems so ingrained in every aspect of her life that it?s hard to imagine her doing something else.

But all stories start somewhere. For McNicholl, leaving her beloved Ireland in 1985 and coming to America was the ?once upon a time? introduction of what turned out to be something like a fairytale.

Her professional life in music began when she left the job at the medical center to spend more time with her young sons, scheduling shows at bars and other venues to earn a little extra money and quickly establishing herself as a respected musician.?Given the surplus of aspiring singer-songwriters in this country, that?s impressive enough. Things, however, were about to get better?and way busier?for McNicholl.

She and her husband relocated their family to Connecticut where she took a job managing the Fairfield County office of Music Together, a program that offers musical education classes for young children all over the country. She attended a training session in order to better understand the organization?s philosophy, but it ended up affecting her much more deeply than that. Not only did she learn the benefits of teaching music to kids during early childhood, but she realized she wanted to do it herself.

?I called my husband and said, ?Okay, this is what I?m going to do forever,?? she remembers. Easier said than done, as all those who have uttered those same words know, but McNicholl meant it.

She began teaching classes, eventually taking over the New Haven Music Together program, which she?s since expanded to nearly 25 classes in the area, including in Woodbridge, Madison, Branford and Hamden, where she lives today, and managing six teachers beside herself while owning two teaching studios. Along the way, she established an umbrella entity called ?Musical Folk,? which encompasses an expansion into classes for older ages too.

The national Music Together program?now celebrating its 25th anniversary?proceeds from the simple premise that all children, even at very young ages, are musical; that they can learn to sing in tune and keep a beat, and Musical Folk carries that forward. But learning doesn?t happen in a vacuum.?Adult participation is key at the mixed-age, weekly classes; moms and dads are encouraged to participate?singing in rounds or dramatically dancing with colorful scarves while their children do the same.

?Parents are the biggest role models,? says McNicholl. While some children take part readily, singing loud and banging a drum, others may simply observe, tucking away that knowledge for later.

Indeed, McNicholl believes introducing music to the newborn-to-five-year-old set has lifelong benefits, and that while people often talk of ?talent,? music is truly a learned skill, applicable to the youngest among us. ?It?s as much their birthright as walking and talking,? she says.

Her enthusiasm is undoubtedly one of the reasons Music Together classes in the New Haven area fill up so quickly, meaning McNicholl is looking for even more teachers to add to the roster.

True to her personality, she?s busy but looking to do even more. She already teaches ukulele and guitar, and excitedly discusses expanding those classes and diversifying the instruction offered, perhaps adding violin. Plans for a children?s dance class and Music Together for children with developmental delays are in the works with some of her teachers, who McNicholl constantly credits for the business?s success.

In terms of access (classes can run $220 per semester, complete with CDs, a music book and other materials, costing less for returning families and siblings), ?I?d never turn away someone who wants to do this,? says McNicholl, who is considering starting a scholarship program.

Still, she makes time to return to her roots, playing solo and with her band, The Crickstones, at venues including The Playwright in Hamden and McLaughlin Vineyards in Sandy Hook. She?s released an album with the band and two on her own. She hasn?t written music for some time, but hopes that someday life will calm down enough for her to do it again.

?I never dreamed that I?d own my own business when I came to America,? she says, and then pauses, worried that she sounds overly sentimental. Which she doesn?t. ?People here take it for granted,? she adds, ?but if you put your mind to it, you can achieve it.?

Achieved it she has, although this fairytale is far from over. If life ever does calm down for McNicholl, it seems she?ll have plenty to sing about.

Every now & then, I am going to email 2 or 3 questions to a group of the web?s smartest health & fitness bloggers. When I have enough answers, I will write up the post and put it online.

In your opinion, what is the healthiest way to eat?

  • Nia Shanks says?.I?m all about simplicity. Simplicity breeds compliance, and that brings about long-term success. I recommend people eat real, natural foods at least 90% of the time, eat approximately .8 grams of protein per pound of bodyweight, and enjoy their favorite treats on occasion because banning certain foods rarely works (exceptions include allergies, of course). It truly can be that easy, and I suggest people give it a try before searching for more strict rules and guidelines. Why make things more complicated than necessary?
  • James Stokes says?Vegan would be the healthiest way to eat. Ironically it?s the hardest to maintain.
  • Kodjo says?Eat small meals throughout the day, preferably 5 to 6 times. First meal (breakfast should be the most important one) should be eaten within an hour of waking up, to jumpstart your metabolism. Between lunch and breakfast, eat a snack. Keep lunch moderate; be generous with cruciferous vegetables. Between lunch and dinner, eat another snack. Eat dinner at least 3 hours before bedtime; and if you feel hungry late at night, eat a small snack. Stay away from artificial sweetners. Drink at least half your body weight in ounces of water daily. For example if you weigh 150 lbs, drink at least 75oz of water daily.
  • Ben from TDF says?We are convinced that having a varied and balanced diet is far more important than any of the faddie dieting ideas that constantly float around the internet. We all know deep down that if we eat a generally healthy and balanced diet, whilst doing at least 30 mins of exercise a day, we will lose weight and feel healthier. Its just that people go looking for an easier one stop solution instead of trying to change their lifestyle for the longer term.
  • Jessica Ellis says?CLEAN. I have read SO many diets and fads and in my experience, eating clean, whole foods?is the best way to go. It?s easy to modify for on and off season and it is a way of life rather than?a ?diet?.
  • Miz Fit says?I firmly believe when we can get there INTUITIVE or mindful EATING is the healthiest approach to food. ? It took me lots of trial & error (and error and error) to get there but I?ve found it to be freeing and ?satiating? on more levels than merely hunger. ?Now that I?m a mindful eater I?ve found it?s spilled over into my being more mindful in all areas of my life. ?For example I?ve become more an ?intuitive? than ?plannedoutscheduled? exerciser as well.
  • William Lockley says?In my opinion, the healthiest way to eat is to eat foods closest to their natural sources ie. whole foods such as fruit, animal protein, natural fats (avocado, nuts, olive/coconut oils) & foods that are higher in fiber.
  • Srdjan Popovic says?The healthiest way to eat is the way our primal ancestors ate for millions of years. Here?s my advice ? 1 -?Minimize your consumption of carbohydrates (grains, starches, sugars) and highly processed foods and drinks. This includes breads, pastas, potatoes, rice, oats, sugary junk foods, and sugary drinks. Fruit intake should also be moderated. 2 -Incorporate as much healthy fat into your diet as you need. Our bodies are designed to use fat as its primary fuel source, not sugar. ? 3- Consume more organically raised meats, lots of fish, nuts, and fibrous vegetables.?Consume moderate amounts of protein. The best sources are from grass-fed, antiobiotic-free, organically raised animals. ??This combination will provide you with optimal health and leanness.
  • Ann Gates says?Eat a healthy, well balanced, recommended portion sized meal 3 times a day.?A healthy, nutritionally rich breakfast is THE most important meal of the day: so don?t miss it! EVER!?Always give your children a healthy breakfast, and sit and eat with them, preferably round the table, to set a good life long example of a healthy lifestyle. Evidence is that families that eat together, stay healthy together!?Adopt the DASH food plan to ensure that you reduce your risks of high blood pressure and heart disease.?Don?t take supplements unless specifically prescribed or advised by your doctor or specialist for your specific health condition. Use the money instead to buy some fresh fish or fruit and vegetables!?Drink water throughout the day, and if you exercise make sure you drink water before, during and after exercise.?Avoid eating any processed food whenever possible. Avoid drinking soda, sugary drinks or eating anything that your grandmother wouldn?t recognise as healthy, home cooked food!?Choose sustainably sourced, fair trade food if you can afford it. When shopping in supermarkets, try and buy fresh produce when you can, and always wash it thoroughly before cooking.?I have always advised patients to buy the best quality, organic food, preferably locally sourced, or grown yourself. There is no real medical evidence for this advice (although some organic food can contain 30% less pesticides, which makes sense to me), but it does seem common sense!?And always enjoy a little bit of what you fancy, in moderation! This great tip was from my Grandmother who lived until she was 94 years old.
  • Waychaun says?I think the healthiest way to eat is consuming small meals, multiple times throughout the day! Ideally, about 5-6 meals will help keep your metabolism burning.
  • Jeff Green says?The key word being ?healthiest?, I would pick the paleo system. Not because it?s hot and popular right now, but because it?s the dietary regimen that addresses so many dietary restrictions yet still is effective in lowering overall body fat and increasing muscular hypertrophy. It addresses lactose issues and gluten issues, it makes up for the sorry lack of animal protein suggested by most diets, it puts fruits and vegetables as the only healthy carb source in its proper hierarchy where fructose can get out of hand so quickly. And lastly, puts nuts and healthy fat sources back in our diets where the belong and does a great job on nutrient timing where fats and carbs are concerned.

For the average person, which is more important?cardio or resistance training?

  • Nia Shanks says?Resistance training, no questions asked. You can achieve the results you?re after (lower body fat, ?toned? appearance) in much less time. The average female gym-goer spends anywhere from 30-60 minutes on a cardio machine 4 or more times per week. They can build a better body with 3 strength training workouts per week that take 30-40 minutes.
  • James Stokes says?Cardio all day. You can do everything else all day but without endurance you?re hit.
  • Kodjo says?You can?t pick one and leave the other. You need a little bit of both. Resistance training will help you build strength while cardio will help you burn stored fat, and promote lean muscles.
  • Ben from TDF says?We hate to sit on the fence but it?s got to be a mix of the 2. We think it?s strange that most people measure their health by weight when most of us know muscle weighs more than fat and really often what people care about is how they look. For that reason resistance training is important. To really enjoy life and for all the health benefits you need to be fit though, so cardio is probably the most important of the two.
  • Jessica Ellis says?BOTH ?- but an average person just starting out, I would focus more on cardio and then slowly?increase resistance training. You need both but cardiovascular health and losing weight is usually?at the top of the list for someone starting out and cardio is great for that.

Always do your cardio after your resistance training. Studies have found that subjects who perform cardio before weights have their growth hormone response to weight training blunted by almost 1,100% compared to when they did resistance training first. But cardio would definitely be the place to start!!

  • Nia Shanks says?.I love push-ups. The sad thing is, everyone knows about them, and most people write them off as an exercise only for beginners. This is a huge mistake because push-ups can be used for building strength, and they?re much more shoulder friendly than barbell pressing exercises. If a traditional push-up is too easy, you can increase the difficulty by performing a more advanced variation, or adding external resistance via bands, weight plates, chains, or a weight vest. The majority of my clients use push-ups as their primary horizontal pushing exercise, and they say their shoulders have never felt better, too.

Zynga to cut 5 percent of its staff

PORTLAND, Ore. (AP) ? Online game company Zynga Inc. is eliminating games, studios and jobs in a bid to cut costs.

The maker of social-media games including "FarmVille" and "Texas HoldEm Poker" said Tuesday that it will cut about 5 percent of its full-time workforce. It's the first-ever round of layoffs at Zynga, which is based in San Francisco and has about 3,200 employees.

Zynga also said it will get rid of 13 older games and reduce its investment in the game "The Ville." It will close its studio in Boston and may close studios in Japan and the U.K. It runs 18 studios worldwide.

Its slumping stock rose more than 3 percent in aftermarket trading following the announcement, which came a day ahead of Zynga's third-quarter earnings report.

The stock also likely got a boost from a better-than-expected earnings report Tuesday by Facebook Inc. Zynga is by far the No. 1 gaming company on Facebook.

Zynga said earlier this month that it expected to post a third-quarter loss due to weak demand for some of its titles. It said its revenues would likely be nearly flat compared to the same period last year.

The company also previously announced that it would adopt some broad cost-cutting measures to help improve its performance.

CEO Mark Pinkus said that the job cuts were the most painful part of the overall cost-reduction plan, which also includes significant cuts in spending on data hosting, advertising and use of contractors.

Zynga makes five of the 10 most popular games on Facebook, according to researcher Appdata. It also accounts for about 12 percent of Facebook's total revenue, so the two companies' fortunes are somewhat tied together.

Zynga's shares rose 7 cents to $2.27 in after-hours trading.

The company went public in December at $10 per share and its stock price peaked in March at $15.91. The stock has lost about 85 percent of its value since then.

Surfer killed in shark attack off coast of California

Francisco Javier Solorio Jr., 39, died in the attack off the coast of Surf Beach in Lompoc, the Santa Barbara County Sheriff's Department said in a statement.

Solorio "had a friend who he was surfing with who saw the shark bite or hit the man," said sheriff's Sgt. Mark A. Williams. "His friend ended up swimming over and pulling him from the water where he received first aid."

The Air Force said Solorio was not affiliated with the base, which allows public access to some of its beaches. All beaches on the base's coastline will be closed for at least 72 hours, as a precaution, Col. Nina Armagno said on Tuesday evening.

The type of shark involved and other details were under investigation.

It was the latest shark attack fatality at Surf Beach, about 150 miles northwest of Los Angeles.

There were no shark warning signs posted at Surf Beach on Tuesday, said Lt. Erik Raney, adding that beaches don't typically post such notices unless the location had a recent shark sighting.

"We've had shark sightings up and down the Santa Barbara coastline pretty frequently recently," said Lt Raney, adding that the sightings are well-publicised.

Death by shark attack is rare. An average of 65 shark attacks occur each year around the world that typically result in two or three deaths, according to the Pew Environment Group.

Insect bites ? Medical Webbook

Tiny puncture wounds in the skin inflicted by blood. sucking insects, such as osquitoes, lice, midges, gnats, horseflies, sand flies, fleas, and bedbugs. Some small arachnids (eight-legged animals similar to insects), such as ticks and mites, can?cause similar injuries.

Most bites cause only temporary pain (or itching for a day or two) although some people have severe skin reactions. In the tropics and subtropics, insect bites are potentially more serious because certain biting species can transmit disease (see Insects and disease).

Causes

Insects that bite do so to obtain a blood meal. The mouthparts of biting insects are specially adapted for piercing skin and sucking blood. Insect bites are most common on exposed parts of the head, hands, arms, or legs. Although mosquitoes (which attack mainly after dark) may be the most troublesome biting insects, many bites blamed on mosquitoes are in fact caused by cat or dog fleas. These fleas inhabit various domestic locations where the pet habitually rests (e.g., carpets, sleeping baskets, or sofas); when their normal host is absent, they may jump onto humans to feed.

Of the more easily visible insects, horseflies can produce a particularly painful bite, while gnats can be a menace if encountered in a swarm.

Symptoms

All insect bites provoke a reaction in the skin that is primarily an allergic response to substances in the insect?s saliva or its feces, which are often deposited at or near the site of the bite and rubbed in by scratching. Reactions vary from innocuous red pimples to painful swellings (which may weep) or an intensely itching rash. People vary in their reactions to the same biting insect; in some people the reaction is extremely severe.

Avoidance

Avoiding insect bites can be particularly important for campers and hikers, anyone living in a mosquito infested area, and travelers or residents in tropical countries.?Bites outdoors can be reduced by wearing trousers, socks, and long sleeved?shirts (especially after dark, when mosquitoes are most active), and by using insect repellents. Indoors, bites can be reduced by using insect screens over open windows and by spraying bedrooms with aerosols containing pyrethroid insecticides?before going to bed. If this fails, it may be necessary to use mosquito nets and slow burning antimosquito coils that give off pyrethroids.

Treatment

Bites or bitten areas should be thoroughly washed with soap and water, and a soothing ointment, such as calamine lotion, should be applied. Scratching should be avoided. If there is a severe reaction, a physician should be called; a cream containing an antihistamine may be required.?Severe itching on the scalp or in the pubic hair suggests the possibility of a louse infestation, which is treated with insecticidal lotions (see Lice). In the case of flea bites, the entire residence (not just the pet) may require treatment with insecticide to Kill the flea population. (See also Spider bites; Mites and disease; Ticks and disease.)

Men with certain cardiovascular risk factors may be at increased risk of peripheral artery disease

ScienceDaily (Oct. 23, 2012) ? Among nearly 45,000 men who were followed up for more than two decades, those with the risk factors of smoking, hypertension, high cholesterol, and type 2 diabetes had an associated greater risk of developing PAD, according to a study in the October 24/31 issue of JAMA.

"Peripheral artery disease (PAD) is a distinct atherosclerotic syndrome marked by stenosis or occlusion [blockage] of the arteries, particularly of the lower extremities. PAD affects 8 to 10 million individuals in the United States, and is associated with reduced functional capacity and increased risk for cardiovascular morbidity and mortality. Despite its widespread prevalence and negative associations with quality of life, morbidity, and mortality, PAD remains underdiagnosed and undertreated," according to background information in the article. Preventable or treatable risk factors for PAD are generally thought to be similar to other forms of cardiovascular disease, however their respective associations with risk of PAD and the extent to which they are jointly associated with the incidence of PAD are not well established.

Michel M. Joosten, Ph.D., of Beth Israel Deaconess Medical Center and Harvard Medical School, Boston, and colleagues conducted a study to estimate the individual and cumulative associations of the 4 conventional cardiovascular risk factors of smoking, hypertension, hypercholesterolemia, and type 2 diabetes with the risk of PAD among men. The study included 44,985 men in the United States without a history of cardiovascular disease at the beginning of the study in 1986; participants in the Health Professionals Follow-up Study were followed up for 25 years until January 2011. The presence of risk factors was updated biennially during follow-up.

During a median (midpoint) follow-up of 24.2 years, there were 537 cases of incident PAD. The researchers found that each risk factor was significantly and independently associated with a higher risk of PAD after adjustment for the other 3 risk factors and confounders. Regardless of duration category, all men with a risk factor had higher risks of developing PAD compared with men without risk factors. Each additional risk factor approximately doubled the risk for PAD. Men who did not have any of the 4 risk factors had a 77 percent lower risk for developing PAD compared with all other men in the group. In 96 percent of PAD cases, at least 1 of the 4 risk factors was present at the time of PAD diagnosis.

Risk of PAD tended to increase with duration of both type 2 diabetes and hypercholesterolemia. Among men with a positive history of hypertension, risk of PAD was higher among men who reported use of 1 antihypertensive drug or 2 or more antihypertensive drugs compared with men with hypertension who did not report current use of antihypertensive drugs. Cumulative intensity of smoking demonstrated a graded relationship with risk.

"In conclusion, in this well-characterized cohort of U.S. men followed up for longer than 2 decades, smoking, hypertension, hypercholesterolemia, and type 2 diabetes each demonstrated strong, graded, and independent associations with risk of clinically significant PAD," the authors write.

Additive restores antibiotic effectiveness against MRSA

ScienceDaily (Oct. 22, 2012) ? Researchers from North Carolina State University have increased the potency of a compound that reactivates antibiotics against methicillin-resistant Staphylococcus aureus (MRSA), an antibiotic-resistant form of Staphylococcus that is notoriously difficult to treat. Their improved compound removes the bacteria's antibiotic resistance and allows the antibiotic to once again become effective at normal dosage levels.

NC State chemist Christian Melander had previously proven the effectiveness of a 2-aminoimidazole compound in reactivating antibiotics against resistant bacterial strains. However, the original compound was not potent enough. In his latest work, described in a paper appearing in Angewandte Chemie, Melander, research assistant professor Roberta Worthington and graduate student Tyler Harris have solved the potency issue, bringing them one step closer to in vivo testing.

"You measure antibiotic effectiveness by growing bacteria in the presence of an antibiotic," Melander says. "The concentration you typically want to observe is about one microgram per milliliter or less of the antibiotic to halt bacterial growth. At that point the bacterial strain is considered susceptible to and treatable by that antibiotic. If a higher concentration of antibiotic is required to halt bacterial growth, the bacterial strain in question is considered untreatable. Some of the MRSA strains we work with require 512 micrograms per milliliter of the antibiotic of choice to control growth - 500 times over the limit. Adding our compound brought the level down to one microgram per milliliter again."

The compound works by short-circuiting the bacteria's ability to mount a defense against the antibiotic. When antibiotics interact with bacteria, receptors on the surface of the bacteria identify the antibiotic as a threat and the bacteria can then choose what to do to survive. MRSA either creates a biofilm or makes genetic changes that prevent the antibiotic from disrupting its cell structure. According to Melander, "We believe that our compound renders the bacteria unable to recognize the antibiotic as a threat, essentially stopping the defensive process before it can begin."

The work was funded by a grant from the U.S. Department of Defense, Defense Medical Research and Development Program.

Wyoming Democrat wages lonely congressional fight

CASPER, Wyo. (AP) ? Chris Henrichsen's hopeful knocking on doors only disturbed the afternoon naps of dogs in a previously quiet Casper neighborhood. Then he finally hit pay dirt: Someone actually answered.

Standing behind a security door, the woman let Henrichsen blurt out a few words, then cut him off. "Running for Congress?" she said. "What party?"

Democrat, Henrichsen replied.

"Wrong house. I'm sorry," she said, slamming the door.

There have been many days like this for the Henrichsen, a political unknown who has virtually no chance of stopping Republican U.S. Rep. Cynthia Lummis from keeping Republican Wyoming's lone U.S. House seat.

Henrichsen, a large man with perpetually rumpled clothes, has logged 5,000 miles in his Suburban, sleeping occasionally in it, to meet with anyone in any corner of Wyoming willing to listen to him. He has no money for staff and travels the highways alone or with his wife and their three young children. But he won't quit.

"I also know that if I stop doing anything today, stop talking to reporters, if I stop knocking on the doors that I can, it goes from slim to zero," explained the 35-year-old Casper College political science instructor.

It's not unheard of for Democrats to win in Wyoming: Three of the last five governors were Democrats. It is, however, difficult, with Republican voters outnumbering Democrats better than 3-to-1.

"I've been there. It's a lonely place," said Democrat Mike Sullivan, the governor from 1987 to 1995. "I know what it's like when there's just the two of you, or maybe even one of you, out on the trail."

The task is even more challenging for Henrichsen, a political newcomer, against Lummis, a well-connected, former state treasurer and state legislator who holds the seat once held by former Vice President Dick Cheney.

In federal financial reports filed in August, Lummis, who's seeking her third term and is state chair of Mitt Romney's campaign, reported raising more than $500,000. Henrichsen was below the $5,000 level needed even to submit a report.

Henrichsen is hardly a typical Democrat. He's a self-described "pro-life" candidate who opposes increased gun control in a state that is among the highest in per-capita gun ownership and where hunting is a proud tradition.

In the political vacuum that is Wyoming Democratic Party politics, Henrichsen faced no opposition in this summer's primary election. He's getting no money from the national or state parties. The national party has larger concerns, and the state party is in apparent free fall, increasingly unable to muster many candidates.

Henrichsen criticized the state party in August, saying it was content to raise money for out-of-state races while neglecting homegrown candidates. Since then, he's tried to convince Wyoming voters that he won't be beholden to Nancy Pelosi when he gets elected.

Henrichsen also said he's received some Democrat backlash about his Mormon faith and his church's opposition to same-sex marriage. "People don't like it," he said.

Robin Van Ausdall, executive director of the Wyoming Democratic Party, said the party is putting its efforts into state legislative races.

"He's not out in the wilderness," she insisted, noting that individual Democrats support him. Rather, she said, it's tough for any Democratic candidate running down-ticket in a presidential election year in Wyoming. In 2008, John McCain defeated Barack Obama here by 65-33 percent.

Henrichsen said Democrats here suffer from popular suspicion that they are would-be gun-grabbers. Too many, he added, are liberal activists who have "gotten comfortable sort of being proud that they're in the minority on those (social) issues, but they're not the issues that are going to build connections with other people" in Wyoming.

If elected, Henrichsen said, he'll work to reduce the deficit, hewing closely to the recommendations laid out by the commission headed by former Wyoming Sen. Alan Simpson and ex-White House chief of staff Erskine Bowles.

"Right now, we have an approach where one side says, 'this is off the table,' and the other side says 'this is off the table,' and there's nothing left on the table," Henrichsen said.

One recent evening, Henrichsen loaded his daughter Geneva, 7, into the family's Suburban for a 300-mile roundtrip run from Casper to Laramie, home to the University of Wyoming and a Democratic oasis, to speak at a library.

About two dozen party faithful showed. They munched free cookies as Henrichsen told them there are so few Democrats on Wyoming ballots that he almost feels almost like he's Obama's state running mate.

Then, he went home.

MINIMUM QUALIFICATIONS, KNOWLEDGE, SKILLS AND ABILITIES:

  • Typically requires an Associate?s degree with an emphasis in Information Technology, or a related discipline, along with two or more years of progressive personal computer technical experience in an Information Technology department. May substitute a certificate in information technology from a recognized organization and equivalent experience in lieu of education.?
  • Requires the ability to apply a comprehensive knowledge of department policies and procedures, and a comprehensive understanding of relevant current personal computers, operating systems and associated peripheral equipment.?
  • Must demonstrate a complete understanding and knowledge of all versions of Windows OS.?
  • Must have experience with managing a Windows environment including applicable tools and technologies within an Enterprise AD infrastructure.?

Saints LB Vilma active for game vs. Tampa Bay

(AP) ? New Orleans linebacker Jonathan Vilma made his debut Sunday while appealing a suspension for his role in the Saints bounty program.

The ninth-year pro didn't start but did get on the field throughout the opening half of the Saints' game against the Tampa Bay Buccaneers.

He pressured Bucs quarterback Josh Freeman on an incompletion that was nearly intercepted by Roman Harper and got his hands on another pass that he tipped first with his right hand and then his left before it fell incomplete.

Vilma has been rehabbing his surgically repaired left knee and practiced for the first time Wednesday. He was moved from the physically unable to perform list to the 53-man roster Saturday.

The linebacker's return could wind up being relatively brief. His appeal hearing on a season-long suspension has been scheduled for Oct. 30.
